THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Effective Date: January 1, 2026. This Notice is provided in accordance with the Health Insurance Portability and Accountability Act of 1996 (HIPAA), 45 C.F.R. Parts 160 and 164, and applicable Florida law.

Our Commitment

Opuluxe Tailored Nursing ("Opuluxe," "we," "our") is a licensed Florida nurse registry. We are committed to protecting the privacy of your Protected Health Information (PHI). This Notice explains how we may use and disclose your PHI and describes your rights regarding that information.

Information We May Collect

Contact information (name, address, phone, email); general descriptions of care needs supplied when you request a consultation; limited health information necessary to match you with an appropriately credentialed nurse; and records related to the nurse referral itself. Detailed clinical information, diagnoses, and medical records should be shared only with the independent nurse you contract with, not through public web forms.

How We May Use and Disclose PHI

For Treatment & Referral: to match you with an appropriately licensed nurse. For Payment: to coordinate billing between you and the independent-contractor nurse. For Health Care Operations: quality assurance, credential verification, and internal recordkeeping. As Required by Law: including reporting suspected abuse, neglect, or exploitation under Florida Statutes Chapters 39 and 415, responding to lawful subpoenas, and cooperating with AHCA inspections and investigations. With Your Authorization: any other use or disclosure will be made only with your written authorization, which you may revoke at any time in writing.

Your Rights

You have the right to: (1) inspect and obtain a copy of your PHI; (2) request an amendment to your PHI; (3) receive an accounting of certain disclosures; (4) request restrictions on certain uses and disclosures; (5) request confidential communications by alternative means or locations; (6) receive a paper copy of this Notice; and (7) be notified in the event of a breach of your unsecured PHI. Independent Contractor Relationship

Opuluxe is a nurse registry regulated under Fla. Stat. Chapter 400, Part VIII. The nurses we refer are independent contractors, not Opuluxe employees. Once you contract with a referred nurse, that nurse becomes a separate covered entity or business associate responsible for their own HIPAA compliance with respect to the care they provide.

Complaints

If you believe your privacy rights have been violated, you may file a complaint with our Privacy Officer at the address below or with the U.S. Department of Health and Human Services, Office for Civil Rights. You may also file a complaint about the registry itself with the Florida Agency for Health Care Administration at 1-888-419-3456. We will not retaliate against you for filing a complaint.
